Brickium Terms of Use

These Terms of Use ("Terms") describe the Brickium service, operated by Zhang Liu (刘章), an individual developer ("we", "us"). Contact: [email protected]. They cover the Brickium app and the service it connects to (together, the "App"). Your licence to the app itself is governed by Apple's Standard EULA.

By using the App you accept these Terms. If you do not accept them, do not use the App. Nothing in these Terms limits rights you have under the mandatory consumer law of the country where you live.

1. Who may use the App

You must be at least 16 years old. If the law where you live sets a higher age for entering into this kind of agreement without parental consent, you must meet that age. By using the App you represent that you meet this requirement.

The App is not designed for children and is not offered in the App Store Kids Category. If you allow a child to use your account, you are responsible for their use of it and for supervising the physical building activity described in section 9.

2. Your account

You can open the App, view the example and browse the design packs without an account. Keeping an inventory, creating models and buying creation packs require you to sign in with Apple or with Google. Accounts created with different sign-in methods are separate and are not merged. You are responsible for anything done through your account. Tell us promptly at [email protected] if you believe it has been used without your permission.

You can delete your account at any time in the App at Me → your account → Delete account. Deletion removes the account record together with your inventory, designs and builds from our servers and cannot be undone. Creations you have bought and not used are deleted with the account and cannot be recovered or refunded. Deactivating an account is not offered as a substitute for deleting it. We keep a minimal record of purchases, as described in the Privacy Policy.

3. What the App does, and what it does not do

The App recognizes building bricks from photographs you take, keeps a record of the parts you tell it you own, generates designs constrained to those parts, and produces assembly instructions.

The App is a design aid. It is not a manufacturer, a retailer, or a safety authority. It does not sell, supply, or verify physical bricks. Recognition is imperfect: you are responsible for reviewing and correcting the parts list before you confirm it, and the App is built to ask you to confirm precisely for that reason.

4. Creations and purchases

4.1 What a creation is

The App counts creations. One creation is one model that the App designs from your bricks, validated as buildable and delivered to you together with its building instructions. Asking for another version of a model is a new creation.

4.2 Free creations

A new account receives one free creation the first time you sign in with Apple or with Google, and one more after you finish your first build. Free creations are given once per person, not once per account, and we may change or end this offer.

4.3 Creation packs

Further creations are sold in creation packs, which are consumable in-app purchases. The size and price of each pack are shown in the App, and the App Store shows the price in your currency before you confirm. Packs are not subscriptions and do not renew.

Purchased creations do not expire while your account exists. They are credited to the account you are signed in to when you buy, cannot be transferred to another account or person, have no cash value, and, like other consumable purchases, cannot be restored to a different account.

4.4 Delivery

Creations are credited as soon as our server has verified the purchase with Apple. If a purchase is charged and not credited, open Me → Creation packs → Sync unfinished purchases while signed in to the same account, or write to us. The same purchase is credited only once.

4.5 Refunds

Purchases are processed by Apple, and refunds are decided by Apple under its own policies; you can ask for one at reportaproblem.apple.com. When Apple refunds a pack we remove the creations it paid for. If they have already been used, your balance may become negative, and later purchases are first applied to that balance. Where the law gives you a right of withdrawal, that right applies as the law provides.

4.6 Changes to packs

We may change the size and price of packs for future purchases. A change does not affect creations you have already bought.

5. Your content

You keep ownership of the photographs and text you provide. You grant us a limited licence to host, process, and display that content solely to operate the App for you: to recognize parts, to generate and validate designs, and to show your own content back to you. This licence ends when you delete the content or your account.

The App has no social features. We do not publish your content, show it to other users, or use it to train artificial intelligence models, and under their API terms our AI providers do not train on it either.

You must have the right to provide what you upload. Do not upload photographs of other people without their permission, and do not upload anything unlawful.

6. Designs the App generates

6.1 What you may do with them

You may build, photograph, share and post the designs and instructions the App generates for you, including for commercial purposes, subject to section 6.3 and section 7.

6.2 Ownership

A design is generated by an automated system from your inventory and your request. In several jurisdictions, including the United States, material generated by a machine without sufficient human authorship may not be protected by copyright at all. Separately, a sequence of assembly steps describes a method of assembly, and methods are not protected by copyright in many jurisdictions; nothing in these Terms gives you exclusive rights over the way a model is built.

We therefore make no representation that a generated design is protected by copyright, or that you own any intellectual property in it. As between you and us, we do not claim ownership of the designs generated for you and we will not assert copyright in them against you. To the extent any intellectual property rights do subsist in a generated design and are owned by us, we assign them to you, if any; to the extent they cannot be assigned, we grant you a perpetual, worldwide, non-exclusive, royalty-free licence to use, reproduce, modify and distribute the design, including commercially. This is not a representation that any such rights exist.

Designs are not unique. Designs are assembled from a finite set of standard parts under the constraint of an inventory. Two people with similar collections will receive similar models, and the same request on another day may produce a design close to one generated for someone else. You should not expect a generated design to be exclusive to you.

Your licence to us. If any intellectual property rights do subsist in a design generated for you, they may vest in you rather than in us. So that we can operate the App, you grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, render, and display those designs and their instructions, for the purpose of showing them back to you, letting you return to earlier versions, and letting you rebuild them later. This licence ends when you delete the design or your account.

Part geometry in the designs is derived from the LDraw Parts Library under a Creative Commons Attribution licence. That attribution obligation travels with any design you redistribute; see section 7.

6.3 Not exclusive

Designs are generated from a finite set of standard parts. Another user, or the same system on another day, may produce an identical or very similar design. You accept that designs are not exclusive to you, and that we may generate similar designs for others.

6.4 No guarantee

We check every delivered design against deterministic rules for parts availability, collisions, connection, and assembly order. Those checks substantially reduce errors, but they do not make the App infallible. A design may still be affected by an error in the parts catalog, by a difference between a real part and its catalog description, or by an inventory record that does not match the bricks you actually have. If you find a step you cannot complete, please report it in the App at that step; reports are how we find and fix these problems.

7. Third-party trademarks and data

LEGO® is a trademark of the LEGO Group of companies which does not sponsor, authorize or endorse this application. Brickium is an independent application and is not affiliated with the LEGO Group. We do not reproduce official building instructions, official product photography, or any LEGO logo.

Parts catalog data is sourced from Rebrickable. Part geometry is derived from the LDraw Parts Library, licensed under Creative Commons Attribution. These sources are credited in the App at Me → About. We are not affiliated with, endorsed by, or sponsored by either project.

Set numbers, part numbers and colour names are used descriptively, to identify parts you own. Nothing in the App should be read as a claim of authorization by any brick manufacturer.

8. Acceptable use

Do not:

We may suspend or terminate an account that breaks these rules. Where the breach is minor and curable we will normally warn you first.

9. Safety

Read this section.

Building bricks include small parts. Small parts are a choking hazard for children under three years old. Wheels, axles, tyres and similar pieces can present additional hazards. Keep bricks away from small children, and supervise children who build.

The App tells you how to assemble a model. It cannot see your actual bricks, cannot judge the condition or authenticity of a part, and cannot assess your surroundings. You are responsible for deciding whether it is safe to build and use a model, and for supervising anyone who does so. Do not use generated models in any application where failure could cause injury or damage, including as a support, a mount, a toy for a child under three, or any part of a vehicle, tool, or electrical device.

Do not use excessive force to assemble parts. If a step does not fit easily, stop and report it in the App rather than forcing it.

10. Availability

We aim to keep the service available but do not promise uninterrupted service, and we may change, suspend or discontinue features. Your account and the creations you have bought are stored durably. Your inventory, generated models and build progress are kept to make the App convenient to use, but we do not guarantee that they will be retained, and they may be reset by maintenance. If we discontinue the App entirely we will give at least 30 days' notice in the App.

11. Disclaimers

To the maximum extent permitted by law, the App is provided "as is" and "as available". We disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that recognition will be accurate, that a design will match your intent, that a design will be buildable in every case, or that the service will be free of errors or interruptions.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law, including liability for death or personal injury caused by negligence, for fraud, or under any non-excludable consumer guarantee. If you are a consumer, you have legal rights that these Terms do not affect.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption, arising out of or relating to the App.

Our total liability arising out of or relating to the App in any twelve-month period is limited to the greater of the amount you paid us for the App in that period and USD 50.

These limits do not apply to the liabilities described in the last paragraph of section 11.

13. Indemnity

You will indemnify us against claims, losses and reasonable legal costs arising from your breach of these Terms, your misuse of the App, or content you upload that infringes someone else's rights.

14. Termination

You may stop using the App at any time and may delete your account in the App. We may suspend or terminate your access if you materially breach these Terms, if we are required to by law, or if we discontinue the service under section 10. Sections 6.2, 6.3, 11, 12, 13 and 16 survive termination.

15. Changes to these Terms

We may update these Terms. We will post the updated version and change the date above. For material changes we will notify you in the App before they take effect. Continued use after that means you accept the updated Terms.

16. Apple

These Terms are between you and us only, not with Apple. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing claims relating to it. Apple and its subsidiaries are third-party beneficiaries of Apple's Standard EULA, which governs your licence to the app.
